Terms of Service

Article 1 - Object

These Terms of Service (TOS) govern the use of the PlayItNow service, a SaaS platform allowing music bands to offer an interactive experience to their audience during concerts. These TOS apply to both bands (paying customers) and spectators (free users).

Article 2 - Service Description

PlayItNow is a web application allowing music bands to create events, manage a song library, and enable the public to vote for songs they want to hear. The service is paid for bands and free for spectators.

Article 3 - Conditions Specific to Bands

The following conditions apply only to bands using the service as paying customers:

3.1 - Registration and Account

To use the service as a band, you must create an account by providing accurate and up-to-date information. You are responsible for the confidentiality of your credentials and all activities performed from your account.

3.2 - Subscriptions and Pricing

Access to the service for bands is subject to a paid subscription. Prices, plans, and subscription conditions are available on the platform. Subscriptions are automatically renewed unless you cancel.

3.3 - Payment

Payments are made through a secure payment provider. In case of payment default, access to the service may be suspended. No refund is due in case of early termination, except as required by law.

3.4 - Obligations

3.4.1 - Customer Obligations

• Provide accurate and up-to-date information

• Maintain confidentiality of your credentials

• Comply with applicable laws and regulations

• Do not use the service for illegal or fraudulent purposes

3.4.2 - Provider Obligations

• Ensure service availability as much as possible

• Provide technical support within service limits

• Implement appropriate security measures

3.5 - Intellectual Property

All elements of the PlayItNow service (code, design, trademarks, etc.) are the exclusive property of axialdata. Use of the service does not grant any ownership rights to these elements.

3.6 - Termination

You can cancel your subscription at any time from your customer area. axialdata reserves the right to suspend or terminate any account in case of non-compliance with these TOS.

3.7 - Applicable Law and Jurisdiction

These TOS are governed by French law. In case of dispute, French courts have exclusive jurisdiction.

Article 4 - Conditions Specific to Spectators

The following conditions apply only to spectators using the service for free:

4.1 - Voting System

When participating in an event, you can:

• Vote for one or more songs according to rules set by the band

• Respect voting limits to avoid fraud

• Use the service respectfully and in accordance with its purpose

4.2 - User Account

Creating an account is optional. You can participate anonymously by providing only a first name. If you create an account, you are responsible for the confidentiality of your credentials.

4.3 - Code of Conduct

It is strictly prohibited to:

• Attempt to defraud the voting system

• Use the service abusively or maliciously

• Use the service for illegal purposes

4.4 - Personal Data

The processing of your personal data is governed by our privacy policy. By using the service, you accept this policy.

Article 5 - Liability

axialdata shall not be liable for direct or indirect damages resulting from the use or inability to use the service. For bands, liability is limited to the amount of sums paid for the subscription. For spectators, the service is provided "as is" without any warranty.

Article 6 - Modifications

axialdata reserves the right to modify these TOS at any time. Modifications take effect upon publication. Your continued use of the service constitutes acceptance of the new conditions.
